Hi,
I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?
1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.
Pls advice about the possibility of getting this H1B extension. I am kind of waiting on this for long.

Hello,
I need an urgent information. My visa stamping in my passport got expired, but I have valid I-797 document. I am planning to have my visa restamping in India. I came to know that with expired visa stamp we can not travel via UK and France. Can you please advice if I can travel via Frankfurt, Germany? or do I need to get a Transit Visa.
Anyone who has travelled through Germany with expired H1B visa stamp?
I have to travel within a week and I would appreciate your advice.

Why do you think anyone in India including the government will spend there political good will to help people like us? Since we are planning to leave India for good and possibly become USC in due course of time there is nothing to gain from helping people like us. . They might ask for H1/L1 etc because it impacts Indian companies.

That is correct. If your employer is enrolled in E-verify then he needs to updated your information in that system otherwise just keep the form for record.
One correction - the employer does not update anything in E-Verify. It is a read-only system to the employers to verify the authenticity of document provided by employees.

It is mentioned by many that PD should be current at the time of GC approval. Is that right?
I know people from India who got their GC approved when their PD is not current.
One can check this easily in looking for I-485 approvals to people from India who submitted their applications concurrently in EB2 category after say april 2004. Disregard the cases which got approved in July 2007. Still there are many cases remaining invalidating the 'rule'!

One of my friend who just finished his masters and in process of getting his OPT in hand, also he is planning to file his H1B visa in 2010.
While his status in OPT he got an oppertunity to own a corporation, my questions to you all as follows.....
1. Can he own a coroporation while his status on OPT? I know one can own a corporation if his/her status is on H1B.
2. If he own corporation with his current status (OPT) and if he files his H1B in year 2010; what issue might he face?
3. Are there any legal obligations to own a corporation while his status on OPT? Or does he require to take any extra measures / precautions to own this coporation?
Note: He just wants own this company and not plan to do anything much to it until he settles down and he wanted utilize this oppertunity.

hi everyone
I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.
Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)
2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )
Any comments or suggestions will be appreciated.

I have an approved I140 and a PD of Apr 08. I am planning to change company .
Some where in May I heard the news that end of this year USCIS is going to halt concurrent filing of I-140 and I485 and introduce an extra step called Pre-App for I485 and which can only be done after I140 approval.
1) what are the chances that this would happen?
2) What will happen if one switches company after 180 days of PreApp of 485.
can he/she invoke Ac21 ?
3) will Pre-App makes one eligible for EAD/Parole ?

Why not pick out one or two of your favorites (or perhaps instead, images that are technically fine but that you don't like and aren't sure why) and post them here? Both Wall Street Journal and New York Times have huge headings under "Immigration Law." But the question is not about immigration law. It is about the fundamental human right to not be judged by the color of our skin.
The proponents of the bill, like Arizona state Sen. Russell Pearce say that the bill "prohibits racial profiling." But I wonder if every individual is stopped and asked for their passports. The will cripple business in the State. Will everyone, ie white, black, brown, yellow, and whatever other color or look need to take their passports, birth certificates, etc to Arizona?
I naturalized into this country and is in the highest tax bracket. I work and pay taxes. Yet I am brown and have an accent. As a practitioner of immigration law, I know say for instance white Canadian who are here, in the US, working illegally, but are white and except for a slight "oot and aboot" has no other accent. Who will the Arizona police "catch"?
The lawsuit is also about separate state and federal rights. The Conservative Supreme Court will champion State rights, but it will remain to be seen whether they champion Separation of Powers. My guess is that their judgment will be clouded by the more emotional issue of immigration.
